First things first, WHAT ARE THE RULES?
This summer has been very busy with rule making sessions to implement the Colorado Natural Medicine Health Act which provides for the therapeutic use of psilocybin mushrooms.
For a comprehensive review of the NMHA, check out “Colorado’s Bold Move to Legalize Psychedelics” written by RZA Legal’s Rachael Ardanuy and co-author, friend and attorney Adam Foster.
Two Colorado state agencies are in charge of licensing and regulating interested participants in natural medicine therapeutic services:
Regulates and licenses healing centers, cultivations, manufacturers, testing facilities, and their owners and employees | Regulates and licenses facilitators of natural medicine services. |
Initial rules for cultivation, manufacturing, testing, storage, distribution, transport, transfer, and dispensation of Regulated Natural Medicine Product became effective July 25, 2024. | Initial rules for becoming a licensed facilitator, approval of training programs for facilitators, and required course content for training programs became effective June 30, 2024. |
Stay tuned for future blogs outlining the DORA regulations for becoming Licensed Colorado Natural Medicine Facilitators, and NMD regulations governing production of Regulated Natural Medicine Products and related packaging, labeling, testing compliance tips, and Licensed Healing Center facility requirements, and more. At RZA Legal, we have years of experience researching and interpreting regulations, assisting in state rule making, and guiding clients on novel regulations as we limit the risk and support the success of our clients in the highly-regulated cannabis and alcohol industries.
